Kyal Group is a pharmaceutical distribution group with its origins in Cuttack, Odisha, where the family pharmaceutical trade began in the mid-1980s. What started as a single agency has grown, over four decades, into a network of ten companies operating across Odisha, West Bengal and Maharashtra.

The group's work sits along the trade channel of the pharmaceutical industry — receiving stock from manufacturers, holding it under proper conditions, and supplying it onward to pharmacies, hospitals and institutional buyers. Across distribution houses, carrying & forwarding operations, a research-led manufacturing company and a western-India healthcare arm, the companies share a common discipline: medicine handled with the care a regulated supply chain demands.

The policies below set out how Kyal Group and its member companies handle information, trade, returns and dispatch. Because the group is a collective of independently constituted companies, a specific transaction is governed by the terms of the member company concerned, read together with these group documents.

§ 01 · Scope

This policy describes how Kyal Group and its member companies (together, the group, we, our) collect, use, retain and protect personal and business information of trade partners, manufacturers, clinicians and visitors interacting with the group through trade dealings, telephone and WhatsApp correspondence, and any digital channels operated by the group or its companies.

§ 02 · Information We Collect

We collect: (a) identity and contact information — name, designation, organisation, business address, telephone, email and statutory identifiers such as GSTIN and drug-licence number; (b) commercial information — order history, invoices, payment references and delivery acknowledgements; (c) technical information from electronic communication, including device and timestamp metadata where applicable; and (d) information voluntarily reported in connection with a product complaint or suspected adverse drug reaction.

§ 03 · Purpose & Lawful Basis

Information is processed on the lawful bases of contract performance, statutory obligation under Indian pharmaceutical and tax law, and legitimate business interest in operating a regulated supply chain. Purposes include order fulfilment, invoicing, drug-licence verification, regulatory reporting, audit compliance, and protection against fraud or product diversion.

§ 04 · Sharing & Disclosure

We share information with: statutory and regulatory authorities where disclosure is required by law; other member companies of the group strictly where needed to serve a request; authorised distribution, logistics and payment partners; and professional advisers under confidentiality obligation. We do not sell personal information.

§ 05 · Retention

Information is retained for the period required to satisfy the purposes above and to comply with record-keeping obligations under the Companies Act, the GST regime and the Drugs and Cosmetics Act. On expiry of that period, records are securely deleted or anonymised.

§ 06 · Security

We apply administrative, technical and physical safeguards proportionate to the sensitivity of the data, including access control and incident-response procedures. No transmission method is perfectly secure; counterparties are asked to apply equivalent diligence on their side.

§ 07 · Your Rights

Subject to applicable law, you may request access to, correction of, or deletion of personal information held about you, by contacting the relevant member company or the group office at Cuttack. We respond within statutory timeframes, subject to identity verification and any overriding record-keeping obligation.

§ 08 · Updates & Governing Law

This policy may be updated from time to time; the current version is the one published here. It is governed by Indian law, and the courts at Cuttack, Odisha have exclusive jurisdiction over any dispute arising in connection with it.

'Group' means Kyal Group, the collective identity of the Kyal pharmaceutical companies. 'Member Company' means any one of the companies listed in the Companies directory. 'Counterparty', 'you' means any person or entity engaging with the group or a member company. 'Goods' means pharmaceutical products supplied by a member company.

§ 02 · Nature of the Group

Kyal Group is a collective brand identity and is not itself a single incorporated legal entity. Each member company is separately constituted and contracts in its own name. Reference to "the group" is descriptive and does not create joint or several liability among member companies. Every trade transaction is with the specific member company concerned.

§ 03 · Use of the Website

This website is provided for general informational purposes. Content — including addresses, contact persons and statutory identifiers — is published in good faith and believed accurate at the time of publication, but may change without notice.

§ 04 · Trade Orders & Eligibility

Trade orders may be placed only by entities holding a valid drug licence and applicable statutory registrations, and are placed with the relevant member company. An order constitutes an offer to purchase; acceptance occurs on dispatch confirmation, until which point the member company may decline an order in whole or in part.

§ 05 · Pricing & Payment

Prices are exclusive of taxes unless stated; applicable GST is charged on every invoice. Payment is due against the terms communicated at order acceptance. Outstanding amounts beyond the agreed period may attract interest, suspension of further dispatch, and recovery proceedings under applicable law.

§ 06 · Use of Goods & Compliance

The counterparty undertakes to handle, store, dispense and resell the Goods in compliance with the Drugs and Cosmetics Act and applicable rules, including cold-chain requirements where stated, and shall maintain records sufficient for batch traceability.

§ 07 · Intellectual Property

All trademarks, the Kyal name and brand elements, product literature and digital assets remain the exclusive property of the group or the relevant member company. Reproduction or commercial reuse without prior written consent is prohibited.

§ 08 · Limitation of Liability

Subject to applicable law, a member company's aggregate liability arising out of any single order shall not exceed the invoice value of that order. No member company shall be liable for indirect, incidental or consequential damages, except where such limitation is excluded by mandatory statute.

§ 09 · Force Majeure

No party is liable for delay or failure caused by events outside reasonable control — natural disaster, public-health emergency, regulatory action, transport disruption or supply-chain failure — provided notice is given and reasonable mitigation undertaken.

§ 10 · Governing Law & Jurisdiction

These terms are governed by the laws of India. The courts at Cuttack, Odisha have exclusive jurisdiction over any dispute arising in connection with them or any transaction governed by them.

§ 01 · General Position

As regulated pharmaceutical suppliers, the member companies do not accept returns of correctly supplied Goods on grounds of changed buying preference. Returns are limited to the scenarios below and are subject to verification.

§ 02 · Where to Raise a Return

A return is processed by the member company that supplied the Goods, identified on the relevant tax invoice. The contact details of every company are in the Companies directory.

§ 03 · Eligible Returns

Returns are eligible where: (a) Goods were supplied in error against the confirmed order; (b) Goods were damaged in transit and the damage was recorded on the proof of delivery; (c) Goods were received with a manufacturing defect or short shelf-life inconsistent with the order; or (d) a regulatory recall has been initiated.

§ 04 · Notification Window

Discrepancies under heads (a) and (b) must be notified within seven (7) calendar days of receipt with photographic evidence and the original delivery acknowledgement. Defects under head (c) must be notified within thirty (30) calendar days of receipt, or within seven (7) days of detection where the defect could not reasonably have been found earlier.

§ 05 · Conditions for Acceptance

Returned Goods must be in original primary and secondary packaging, with intact batch and expiry information, free of any tampering or relabelling, and accompanied by the relevant invoice number and a signed return authorisation issued by the member company.

§ 06 · Cold-chain Goods

Cold-chain products are accepted for return only where temperature integrity throughout the chain can be evidenced by data logger or equivalent record. A cold-chain breach disqualifies a return regardless of physical condition.

§ 07 · Refund Mechanism

Approved returns are credited against future invoices, or refunded to the originating bank account at the member company's discretion, within fourteen (14) working days of acceptance of the returned consignment. GST adjustments are processed through a compliant credit note.

§ 01 · Coverage Area

Member companies dispatch Goods to verified trade addresses where the counterparty holds a valid drug licence and where the company is in a position to serve under prevailing logistics and regulatory conditions. Service to a particular location is confirmed at order acceptance.

§ 02 · Order Processing Time

Confirmed orders are typically picked, packed and dispatched within two (2) to four (4) working days of acceptance, subject to product availability and successful drug-licence verification. Cold-chain consignments may follow a separate dispatch cadence.

§ 03 · Dispatch & Carriage

Dispatch is undertaken through logistics partners selected for pharmaceutical handling capability and, where applicable, cold-chain qualification. Tracking references, where issued by the carrier, are shared with the counterparty's nominated contact.

§ 04 · Cold-chain Handling

Temperature-sensitive Goods are dispatched in qualified shipper systems with data loggers as required by product label. The counterparty is asked to inspect the logger record on receipt; any excursion must be flagged before unpacking and stocking.

§ 05 · Delivery, Inspection & POD

On delivery, the counterparty's representative must inspect the consignment for parcel count and visible damage and record any discrepancy on the proof of delivery. Acceptance without such notation is treated as acknowledgement of correct delivery.

§ 06 · Charges & Failed Delivery

Logistics charges, where applicable, are stated at order acceptance and itemised on the invoice. Where delivery cannot be completed because the consignee is unavailable or refuses receipt, Goods are returned to the nearest hub; re-dispatch attracts further charges, and short-shelf-life Goods may be quarantined.
